Enforcing Justice: Ed's Actions Against Aam Aadmi Party Scrutinized

Ed's Enforcement Against Aam Aadmi Party: A Matter of Law

Allegations of Political Witch Hunt

Despite the high conviction rate of 95% in Prevention of Money Laundering (PMLA) cases, there have been accusations that the Enforcement Directorate (ED) is being used politically to target Aam Aadmi Party (AAP). However, it is important to note that the ED is not an independent agency but an arm of the government.

Alleged Contradictory Actions by the AAP

Six months after the arrest of a Congress MLA, spotlight remains on the ED's investigations, raising questions about due process and political ramifications. In this case, the ED was praised for its actions. However, in the case of AAP, the agency is being accused of political bias.

Legal Basis for ED's Actions

We emphasizes that all provisions used by the ED have been vetted and approved by the Supreme Court. These provisions include the reverse burden of proof, the stringent granting of bail, and the admissibility of statements made to the ED.

Alleged Offenses by AAP

We refer to a Supreme Court order that ruled that excess commission earned by the Wholesale Distributor of 338 crores constitutes an offense under the PC Act. It is alleged that these proceeds are proceeds of crimes.

Judicial Oversight

We acknowledge that the ED is an arm of the government but emphasize that every step of the ED's investigation has been closely scrutinized by the judiciary. The High Court has been adjudicating on the matter and has kept a keen eye on the proceedings.

Conclusion

We argue that while the ED may be an arm of the government, the fact that the judiciary has been overseeing its actions indicates that accusations of political bias are unfounded. Unless one is also willing to accuse the judiciary of corruption, there is no basis for such claims.
